Declaration of Trust

A Declaration of Trust is drawn up to show whether a property is to be held in equal or unequal shares. It will set out the contributions that each person has made to the purchase of the property and what happens if anyone wants to sell. It can also make clear how the property expenses will be paid whilst it is jointly owned.
Declarations of Trust are use useful when people are buying a home together and want to set out the shares in which it is held; they can be as simple or as complicated as is needed 

Deed of Variation

A Deed of Variation is sometimes called a Deed of Family Arrangement and is a way for beneficiaries under a will to agree to change the way the estate is shared out so that Inheritance and Capital Gains Tax can be minimised or a more equitable distribution achieved. For example a will leaving an estate to mature children can be altered so that the estate skips a generation and is passed to the grandchildren who may be struggling financially.

This can be done up to two years after the date of death and before the estate is distributed. 

Powers of Attorney

A Lasting Power of Attorney (LPA) is a document that we can prepare that lets you appoint someone that you trust to act as your ‘attorney’ to manage your affairs or make decisions on your behalf.

This document can be drawn up at any time while you are still mentally capable. We will register your LPA with the Office of the Public Guardian and this means that it can be used at any time, whether you have the mental ability to act for yourself or not.
You can create two types of LPA:-

Property and Affairs LPA
A Property and Affairs LPA allows you to choose someone to make decisions about how to spend your money. This can include decisions on the way your property and affairs are managed.

Personal Welfare LPA
A Personal Welfare LPA allows you to choose someone to make decisions about your healthcare and welfare. This includes decisions to refuse or consent to treatment on your behalf and deciding where you live. These decisions can only be taken on your behalf when the LPA is registered.
